A Wexfordman who tilled and sowed down land belonging to another person has been sent forward for trial by judge and jury on a not guilty plea.
John Kinsella, of Tomadilly, Marshalstown, Enniscorthy, Co Wexford, came before Judge Cormac Quinn at a sitting of Wexford Circuit Criminal Court.
The 43-year-old farmer pleaded not guilty to the charge that on 28 October 2017, at Lodgewood, Ferns, Enniscorthy, Co Wexford, without lawful excuse damaged property, by tilling land and sowing a crop, and that these actions impaired the operation of the land to the value of €29,840, belonging to John B Dockrell, intending to damage such property or being reckless as to whether such property would be damaged.
Not guilty
Defence counsel Jordan Fletcher BL told the court that the defendant is pleading not guilty. He said that a jury would be required.
The trial, he said, would last up to five days. He asked for a date for hearing.
Judge Quinn said he would remand the defendant on continuing bail to 6 February next. He said the matter would be in for mention to fix a date for hearing.
